1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the FlatSwipe mobile application and website (the "Service"), operated by Launchborn LLC ("we," "us," or "our"), a company organized under the laws of the State of Wyoming, United States.

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding legal agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

You may create an account using Email magic link, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under your account.

You agree to provide accurate and current information and to promptly update it if it changes. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

You may also browse listings as an anonymous user without creating an account. Certain features (saving favorites, creating listings, contacting landlords) require authentication.

4. Description of the Service

FlatSwipe is a rental marketplace that connects tenants with property listings. The Service provides a swipe-based interface for discovering rental properties, saving favorites, and connecting with landlords or property managers. The Service is available as a mobile application (iOS and Android) and a web application.

FlatSwipe is a listing platform only. We are not a party to any rental agreement between tenants and landlords. We do not own, manage, or inspect any properties listed on the platform. We do not guarantee the accuracy, quality, safety, or legality of any listing.

5. User Content & Listings

You retain ownership of the content you submit (photos, descriptions, listing details). By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute your content for the purpose of operating and promoting the Service. This license includes the right to:

• Resize, compress, and convert your images to optimize delivery
• Translate your listing text into other languages using AI
• Display your content across all platforms (mobile app, web, marketing materials)

You represent and warrant that:

• You have the right to post the content you submit
• Your content does not violate any third-party rights
• Listing information is accurate and not misleading
• Photos accurately represent the property being listed

We reserve the right to remove or modify any content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Content Moderation & Automatic Translation

6.1 Automated Moderation

All user-generated content (listing text and images) is automatically screened for policy violations using AI-powered moderation systems. Content that is flagged may be rejected automatically without prior notice. Categories checked include but are not limited to: violence, harassment, hate speech, sexual content, and fraud.

If your content is rejected by automated moderation, you may contact us to request a manual review.

6.2 Automatic Translation

Listing content is automatically translated into multiple languages to make it accessible to users across different regions. Translations are generated by AI and may not be perfectly accurate. We are not responsible for errors or misunderstandings arising from automated translations. The original language version of your listing is considered authoritative.

6.3 Duplicate Detection

Our system automatically detects and groups listings that appear to be duplicates based on location, pricing, and other attributes. Grouped listings may be displayed together to help users compare options. If you believe your listing was incorrectly grouped, contact us for review.

7. Identity Verification

We offer an optional identity verification feature that allows landlords to earn a "Verified" badge on their profile and listings. Verification is processed by our third-party provider, Didit, and involves submitting a government-issued ID and a selfie for facial comparison.

• Verification confirms that the user is a real person with a valid identity document. It does not confirm property ownership, landlord status, or the accuracy of any listing.
• The "Verified" badge is displayed at our discretion and may be revoked if we determine the verification was obtained fraudulently or the user violates these Terms.
• We are not liable for any losses arising from reliance on a verified status. Users should always exercise their own due diligence.

8. Subscriptions & Payments

The Service offers optional paid subscription plans that unlock additional features (such as increased listing limits). Free-tier users may create a limited number of listings.

8.1 Mobile Subscriptions

Subscriptions purchased through the iOS or Android app are billed through the Apple App Store or Google Play Store respectively, via our subscription management partner RevenueCat.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's App Store or Google Play settings
• Refunds are subject to the policies of Apple or Google, as applicable

8.2 Web Subscriptions

Subscriptions purchased through the website are processed by Stripe. Stripe handles all payment information directly and is PCI DSS Level 1 certified.

• Refund requests for web subscriptions should be directed to support@flatswipe.app

We reserve the right to change subscription pricing at any time. Price changes will not affect active subscription periods.

9. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings
• Post duplicate listings for the same property to gain unfair visibility
• Impersonate any person or entity
• Obtain identity verification using fraudulent documents
• Use the Service for any illegal purpose or in violation of applicable laws
• Scrape, harvest, or collect data from the Service by automated means
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or its servers
• Harass, threaten, or abuse other users
• Post spam, unsolicited advertising, or promotional content
• Circumvent or manipulate subscription limits, content moderation, or access restrictions

10. Account Suspension & Bans

We reserve the right to suspend or permanently ban any user account that violates these Terms. Actions that may result in suspension or a ban include but are not limited to:

• Repeated posting of content that fails moderation
• Fraudulent identity verification attempts
• Confirmed reports of scam or fraud from other users
• Abuse of the contact or messaging features
• Any violation of the Prohibited Conduct section above

When an account is banned, all associated listings are deactivated. If you believe your account was suspended or banned in error, you may contact us at support@flatswipe.app to request a review.

11. Intellectual Property

The Service, including its design, code, branding, graphics, and all other proprietary materials, is owned by Launchborn LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

"FlatSwipe" and the FlatSwipe logo are trademarks of Launchborn LLC. You may not use them without our written permission.

12. Copyright Complaints

If you believe that content on the Service infringes your copyright, please send a written notice to legal@flatswipe.app including:

• Identification of the copyrighted work
• Identification of the infringing material on our Service
• Your contact information
• A statement that you have a good-faith belief the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information is accurate
• Your physical or electronic signature

We will review and respond to valid copyright notices in accordance with applicable law.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse and are not responsible for the accuracy or reliability of any listing, content, or information posted by users. Automated translations and AI-generated content may contain inaccuracies.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAUNCHBORN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify and hold harmless Launchborn LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice, in accordance with Section 10. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

You may delete your account at any time through the app settings or by contacting us. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
