1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the FlatSwipemobile application and website (the "Service"), operated by Launchborn LLC("we," "us," or "our"), a company organized under the laws of the State of Wyoming, United States.

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding legal agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

You may create an account using Email link sign-in, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and current information and to promptly update it if it changes. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

4. Description of the Service

FlatSwipe is a rental marketplace that connects tenants with property listings. The Service provides a swipe-based interface for discovering rental properties, saving favorites, and connecting with landlords or property managers.

FlatSwipe is a listing platform only. We are not a party to any rental agreement between tenants and landlords. We do not own, manage, or inspect any properties listed on the platform. We do not guarantee the accuracy, quality, safety, or legality of any listing.

5. User Content & Listings

You retain ownership of the content you submit (photos, descriptions, listing details). By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Service.

You represent and warrant that:

• You have the right to post the content you submit
• Your content does not violate any third-party rights
• Listing information is accurate and not misleading
• Photos accurately represent the property being listed

We reserve the right to remove or modify any content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Subscriptions & Payments

The Service offers optional paid subscription plans that unlock additional features. Subscriptions are billed through the Apple App Store or Google Play Store, subject to the terms and pricing displayed at the time of purchase.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's App Store or Google Play settings
• Refunds are subject to the policies of Apple or Google, as applicable

We reserve the right to change subscription pricing at any time. Price changes will not affect active subscription periods.

7. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings
• Impersonate any person or entity
• Use the Service for any illegal purpose or in violation of applicable laws
• Scrape, harvest, or collect data from the Service by automated means
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or its servers
• Harass, threaten, or abuse other users
• Post spam, unsolicited advertising, or promotional content
• Circumvent or manipulate subscription or access restrictions

8. Intellectual Property

The Service, including its design, code, branding, graphics, and all other proprietary materials, is owned by Launchborn LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

"FlatSwipe" and the FlatSwipe logo are trademarks of Launchborn LLC. You may not use them without our written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse and are not responsible for the accuracy or reliability of any listing, content, or information posted by users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAUNCHBORN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Launchborn LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

You may delete your account at any time through the app settings or by contacting us.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
